Cedarfield II Homeowners’ Association, Inc (“Cedarfield II”, or “Association”) is an organization of neighbors who work together toward common goals. Those goals are to maintain community assets and property values, and to offer social and recreational activities. All members are invited to participate in the life of the neighborhood and to enjoy our pool, playground, common area and walking paths.
The Association is a legal, non-profit corporation that was established during development of the neighborhood and is governed by several documents:
• Articles of Incorporation create the Association and define its membership and the purpose
• By-Laws outline the rules and powers of the Association
• Declaration of Covenants, Conditions and Restrictions (“CCR”) outline the rights and obligations of homeowners
• Declaration of Restrictions and Amendment to the Declaration of Restrictions, along with the Architectural Control Guidelines, list specific standards for property appearance and use.
Deed restrictions placed upon each property in advance of development and subsequent sales subject all homeowners to mandatory membership in the Association, and compliance with all restrictions, whether informed or not at time of closing. All amenities and common property are owned by the members of the Association who share equally the financial responsibility for maintaining them. Members also have an obligation to abide by the CCR, Restrictions and Architectural Control Guidelines, and to pay their assessments.
The Association is made up of volunteers who make up the Board of Directors and activity committees. The Association is better when everyone lends a hand to serve on the board or one of the committees.
The Association Board of Directors (“Board”) is a panel of five Cedarfield II residents, popularly elected at the annual meeting of the Association if there are enough members present to establish a quorum, or appointed by the board when there is no quorum. Each Director serves a three (3) year term that are staggered to have overlap and continuity, and they are obligated to act in the best interests of the Association. Responsibilities of the Association are defined and mandated by the documents which establish the ‘constitution’ of the neighborhood. It is the obligation of the Board to carry out these responsibilities in a responsible, fair, and equitable manner.
The Board meets once a month and otherwise, as needed, to conduct the business of the Association. The Board contracts with different vendors to provide services such as Association management, landscaping, and pool management. It instructs the management company, determines the budget, authorizes expenditures, sets policies regarding collection of assessments, and enforces covenants/restrictions. When necessary, the Board may take legal action as prescribed within the governing documents to either enforce covenants/restrictions or to collect annual assessments. The Board may also notify residents of hazards which may exist on their property. The Board is continually watchful for ways to maintain or improve the community for the benefit of all members.
Cedarfield II uses the services of Hawthorne Management Group (www.hawthornemgmt.com) to collect assessments, manage communal assets, enforce covenants, coordinate filing of liens and foreclosures, provide accounting services, and send email and mail communication to members. We encourage all homeowners to register and use Hathorne’s website to be able to view your account, setup payments, submit architectural change requests, or respond to violation notices.
Committees are part of the crucial infrastructure of Cedarfield. They plan social activities, perform architectural control, prepare written materials, oversee the pool and recreational facilities, monitor rental property restrictions and provide guidance to the Board of Directors. Service on a committee is a great way to get to know other people and learn about how the HOA functions. Please join us on one of these committees.
